Port of Oakland Reports Best September For Import Volume In Its History

Imports up 10.6 percent, exports up 5 percent compared to Sept. 2019

Oakland – October 14, 2020: The Port of Oakland experienced its best September ever for import cargo volume. The Port said 93,916 twenty-foot (TEU) full import containers last month beat a 2019 record of 84,901 TEUs. The Port also said today that containerized import volume jumped 10.6 percent in September compared to 2019 totals. Exports were also up 5 percent compared to September 2019. Total TEUs for September were 225,809 up 9.3 percent compared to September 2019 when TEUs were 206,539.

The Port attributed the boost in imports to U.S. retailers stocking up in preparation for the traditional holiday shopping season. Consumer products combined with pandemic-related items such as personal protective supplies helped make September a record-breaking month.

“Several months into this pandemic, we are now seeing positive signs by these cargo volume totals,” said Port of Oakland Maritime Director Bryan Brandes. “As retailers make sure shelves are well-stocked, we’re waiting to see if consumers begin shopping early this holiday season.”

The Port said it’s seeing retailers hedging against another possible COVID wave this winter. Retailers appear to be building up their stocks as they continue to see the spread of more factory closures and lockdowns.

Compared to last year, this year’s first nine months show full imports up 0.4 percent and full exports down 0.2 percent.

#OaklandUndivided Reaches Major Milestone in Effort to Provide 25,000 Oakland Students with Free Computers and Internet Access; Media is Invited to Laptop Distribution Event on Thursday

Oakland, CA — Eric Yanez (below), a 4th-grader at Hoover Elementary School, had problems with distance learning. But many of those challenges have evaporated as Eric now has a computer and internet access through the #OaklandUndivided campaign. “My son got a Chromebook from #OaklandandUndivided and it has helped tremendously,” said Guadalupe Canchola, Eric’s mother. “We both are so grateful as it has helped to ease the new way of school with distance learning. Initially, he would use my phone for the zoom class and a borrowed tablet for the actual school work and it was just so different and a little frustrating a lot of the time.”

Those challenges are exactly what the #OaklandUndivided campaign is designed to address for all Oakland public school students in need. The campaign, which is a joint venture of Tech Exchange, Oakland Promise, Oakland Public Education Fund, the City of Oakland and Mayor Libby Schaaf, and OUSD, began about five months ago with one goal: to ensure every public school student in need has access to a computer, internet, and tech support. While the work is far from over, this is an important update for the community on some key milestones coming out of last week’s National Digital Inclusion Week, during which the campaign handed out devices at 25 schools across Oakland and highlighted the impact these devices and resources have had on families and teachers.

Most importantly, this week, the campaign expects to reach the halfway mark and hand out the 12,500th computer of the original 25,000 units. These devices are for students to keep at home and to provide consistent access for families.
On Thursday, October 15 the campaign will host a computer distribution event with Mayor Schaaf and OUSD School Board District 7 Director, James Harris at Castlemont High School.

The focus for the #OaklandUndivided team after that will be to get the rest of the 25,000 computers into the hands of Oakland students in need.

“Everyday we get closer to closing the digital divide in Oakland,” Mayor Libby Schaaf said. “This week marks a critical milestone, but it is only progress achieved — not mission accomplished. We’ll continue to work with our amazing community partners until the digital divide is closed for good, and every child and family in Oakland has a device and the consistent internet access they need to reach their full educational potential.”

Until they receive the #OaklandUndivided computers, Oakland students in district-run and charter schools who have needs for technology at home, still have one of the more than 23,000 computers and 7,000 hotspots that were loaned out by schools since the shelter in place took effect last March. “We are pleased that the #OaklandUndivided campaign has made such important progress,” said OUSD Superintendent Kyla Johnson-Trammell. “It’s obvious that in this time of distance learning, we have prepared our students for success by ensuring that they have the tools they need at home to fully access their education. I thank the #OaklandUndivided team for all their hard work. It has indeed paid off!”

Almost all students have either a loaner or an #OaklandUndivided device. But the campaign knows there are some students who remain disconnected. If you are a family in Oakland public schools, make sure to fill out the Tech Check survey to receive your device(s) to ensure your student has access to a computer and the internet. If you know of a student or family in need who does not currently have access to technology resources, including a computer to participate in remote learning, please complete the OUSD Technology Intake Form. OUSD will ensure that the students identified there receive a computer within 48 hours.

One of the most important aspects of this effort has been the tech support supplied by the campaign. OUSD students can be confident that any issues they encounter with their device or internet access will be addressed quickly. So far, there have been a few problems, which the team quickly resolved. If families are having any issues with #OaklandUndivided devices such as mic issues, error messages, etc., they can contact Tech Exchange for support by texting or calling 510-866-2260.

Parents are clearly pleased with the results. “His interaction in class has been awesome and his weekly grades have been 100%,” said Guadalupe Canchola, mother of Hoover Elementary student, Eric Yanez. “Thank you all again for providing and donating such an important tool for our kids to continue learning despite anything new being thrown their way.”

Manhattan District Attorney Cy Vance issued this press release:

Manhattan District Attorney Cy Vance, Jr. today filed charges against AMY COOPER, 41, in New York County Criminal Court. Ms. Cooper is charged with Falsely Reporting an Incident in the Third Degree, a misdemeanor, for falsely reporting an assault in the Central Park Ramble on May 25, 2020. [1]

“Our Office is committed to safety, justice, and anti-racism, and we will hold people who make false and racist 911 calls accountable,” said District Attorney Vance. “As alleged in the complaint, Amy Cooper engaged in racist criminal conduct when she falsely accused a Black man of trying to assault her in a previously unreported second call with a 911 dispatcher. Fortunately, no one was injured or killed in the police response to Ms. Cooper’s hoax. Our Office will pursue a resolution of this case which holds Ms. Cooper accountable while healing our community, restoring justice, and deterring others from perpetuating this racist practice.”

As alleged in the Complaint and as stated on the record in court by Executive Assistant D.A. Joan Illuzzi, Ms. Cooper called 911 and told a NYPD dispatcher that a Black male was threatening her inside the Central Park Ramble. In a previously unreported second phone call, Ms. Cooper repeated the accusation and added that the man “tried to assault her.” When responding officers arrived, Ms. Cooper admitted that the male had not “tried to assault” or come into contact with her.

Executive Assistant D.A. Joan Illuzzi (Chief of the Trial Division) is handling the prosecution of this case.

D.A. Vance thanked the members of the New York City Police Department’s Central Park Precinct and Communications Section for their assistance with the investigation.

Las Vegas People Mover To Allegiant Stadium Could Benefit From Tax Increment Financing

On Thursday, October 15th, the Las Vegas Stadium Authority, which owns the $2.2 billion Allegiant Stadium that’s home to the Las Vegas Raiders, will take up an exciting project: Pay Pal founder Elon Musk’s tunneling and transportation startup The Boring Company’s Las Vegas People Mover To Allegiant Stadium.

Specifically, the Las Vegas Stadium Authority will give thumbs up to the eventual building of a station stop at Raiders Stadium. But the question is, how did we get here?

The project started last May 19th, 2019, when The Boring Company landed a $48.7 million project to shuttle people in an underground Loop system around the Las Vegas Convention Center. But, as happens with this ever changing project in a city that likes to jump on futuristic transportation ideas as early adopters (like the Disney-style Monorail system that is now a bankrupt organization with miles of unused track over and around the Las Vegas Convention Center), casino executives, and now the Raiders, want in on what The Boring Company’s working on.

All of this, while there’s no news on any increase in project funding!

And just what is it? Basically, it takes the Disney People Mover concept and puts it underground – except it does not use small cart style cars propelled by linear-induction motors. Rather, it uses what are best described as electronic guide wheel cars. If you see the proposed route, and consider that, for events like CES, the Las Vegas Strip can be and has been paralyzed by cars and taxis and ride-share vehicles taking people everywhere throughout the town, then you automatically see the potential for what Elon Musk’s building.

And that’s why I believe the routes off the Las Vegas Convention Center and to and Allegiant Stadium will dramatically increase real estate activity in the parcels of land that are along the underground tracks. Right now, there’s no way to literally capture the increased real estate land value that is already happening because of the twin developments of Allegiant Stadium and the Las Vegas People Mover. But a tax increment financing zone would allow such revenue to be captured.

The way tax increment financing (TIF) works is that the Nevada Legislature would have to approve an adjustment in Senate Bill One, allowing the designation of a TIF zone around Allegiant Stadium. The reason for this, is that the direction of the collection of property tax has to be shifted to a special organization tasked with using the TIF revenue by legislation – here, that would be The Las Vegas Stadium Authority on behalf of Clark County. The Las Vegas Stadium Authority has to approve the proposal before it can move on to the Nevada Legislature.

Once the Nevada Legislature approves the addition (or re-addition) of the TIF zone since something like what I am referring to was in the original Senate Bill One of 2017, the matter of ratifying the TIF zone then goes to Clark County (if I recall how municipal governance is done in Nevada).

Of course, prior to all of that, Clark County has to draw up the TIF zone around Allegiant Stadium. The property tax collected from that zone can be used, in part, to help finance the Las Vegas People Mover Allegiant Stadium Station.

Hopefully, Clark County does some kind of action to help pay for the station, as well as the other off-site infrastructure improvements needed so that patrons can easily get to the Raiders new NFL stadium.

City Of Oakland, Working Solutions, Launch Home-Based Business Grant Program

Oakland – The City of Oakland received $36.9 million in State of California CARES Act funding. Of that amount, the Oakland CARES Act Home-Based Business Grant Program will distribute $500,000 in grants of $2,000 to $4,000 to home-based, for-profit businesses in Oakland. Working Solutions, a Bay Area nonprofit, is administering the application and grant-making process. The grant application period closes at 11:59 p.m. on Monday, November 2. Online applications in four languages are available at: https://www.workingsolutions.org/oakland-home-based-grants.

“We recognize that revenue from a home-based business is often a major source of household income for our entrepreneurs, and losses due to the pandemic are pushing vulnerable populations to the brink of economic and housing insecurity,” said Oakland Mayor Libby Schaaf. “This grant program supports Oakland’s entrepreneurial spirit reflected in the wide variety of home-based businesses found in The Town.”

Priority will be given to home-based businesses representing a broad geographic diversity in Oakland, especially those located in low-income areas or otherwise historically vulnerable communities; those who have received $4,000 or less in funding from the Paycheck Protection Program (PPP); and those with annual gross business revenue under $150,000. The grant amounts of $2,000 to $4,000 will be based on gross revenue of the home-based business.

“Working Solutions is proud to partner with the City of Oakland to make grants to home-based small business owners in Oakland who are struggling due to the COVID-19 pandemic,” said Sara Razavi, CEO of Working Solutions. “This grant program will provide immediate relief to local home-based business owners, who face their own unique challenges during this crisis, and is an important follow-up to our work with the City this spring and summer through the Oakland Small Business Emergency Grant Program.”

In order to be eligible for this grant program, the business must:

Be verified as a for-profit, home-based business in Oakland;
Have a valid Oakland business license;
Have been in operation prior to March 1, 2019;
Be able to demonstrate negative impacts to the business from the COVID-19 pandemic;
Certify that the home-based business income represents the majority (>50%) of the applicant’s total individual income; and
Be a U.S. citizen or permanent resident (due to restrictions associated with federal CARES Act funding sources).

Business owners who previously received a grant from the Oakland Small Business Emergency Grant Program (between April and July 2020) are eligible to apply for this grant program.

Grant funds may be used for COVID-19-related costs and losses, such as payroll; rent or mortgage payments; utilities or other operating expenses; or fixtures, supplies, and other non-construction site modifications needed to satisfy COVID-19 distancing and mitigation requirements. Funds may not be used for new construction or building improvements.

Other Grant and Support Programs Available

This is the latest CARES Act-funded program launched by the City of Oakland. Grant programs for small businesses, individual artists and arts nonprofits,

community-serving nonprofits and low-income renters and homeowners were announced in September. Additionally, free legal advice webinars and consultations on lease negotiations for small businesses were announced last week. Businesses may only receive a grant from one CARES Act-funded program. San Francisco 49ers Attempt to Comply with Prevailing Wage Laws In Santa Clara County

Santa Clara – The Santa Clara Stadium Authority Board tonight will consider the San Francisco 49ers’ request to purchase LCPtracker, a software system for certified payroll reporting, construction site compliance management and workforce reporting. These are critical elements of reporting to the Department of Industrial Relations for compliance with state worker wage laws (e.g., prevailing wage). Sadly, this request is more evidence that the San Francisco 49ers have not been properly complying with State Prevailing Wage Law for the first six years as the manager of Levi’s Stadium.

“The exploitation of workers is especially egregious when committed by wealthy corporations who prioritize profits over people. We have a collective responsibility in Santa Clara to protect and pay low-wage workers who are employed by a billion-dollar industry.” Jean Cohen, Interim Executive Officer of South Bay Labor Council, commented.

The Stadium Authority’s review of the 49ers’ request found significant errors and omissions to enter into a contract to comply with the prevailing wage law, such as:

– Mismanagement of a public contract by requesting 90% above contract value without explaining the need for additional funds;

– Removing, without any disclosure, their duty to comply with federal and state laws, including transparency laws, e.g., Brown Act or Public Records Act; and,

– Lack of fiscal transparency.

“We are concerned that the 49ers Management Company is still committing wage theft and the City and State need to stop it,” Mayor Gillmor added. “Over a year ago, we discovered that the 49ers had not been complying with the State’s Prevailing Wage law. A year later, the 49ers submit a request to purchase a software system commonly used to comply with the prevailing wage law, but they have removed from the contract their requirement to comply with California’s Ralph M. Brown Act and the Public Records Act, and any other federal or state laws that may apply. This is not acceptable!”

This situation raises additional concerns by the Stadium Authority with how the team has managed prior contracts. In September 2019, the Stadium Authority Board rescinded the Executive Director’s delegated purchasing authority. As a result of the Board’s action, effective Nov. 8, 2019, the 49ers must now seek approval from the Board and demonstrate properly and legally procuring goods and services before contracts may be executed.

London, UK – The inevitable has finally happened, after starting last season 1-7, and now this year 0-5, head coach Dan Quinn and general manager Thomas Dimitroff are out in Atlanta as head coach and general manager, respectively of The Atlanta Falcons.

Looking in from the outside the franchise looks set up to be a playoff team but a closer inspection made beg to differ on that opinion. The Atlanta Falcon are not a sleeping giant; this organization has a history of making bad choices and handing out even worse contracts.

Established in 1966, the Atlanta Falcons, to date have lost a hundred more games that they have won. The team did not produce back to back winning seasons until 2009. Their list of failures reads like a Stephen King horror novel.

Peerless Price, Bobby Petrino, Ray Edwards, Jamal Anderson (the DE not the RB), Sam Baker, Ed Hartwell, Tyson Jackson, Dunta Robinson, Pierra Jerry, the debacle in London, Vic Beasley, 28-3, that week two loss in Dallas…….. Will it ever end?

The current roster has some failed experiments too, Isaiah Oliver, Deadrin Senat, Damontae Kazee, Takk McKinley, and James Carpenter. The time has also surely come for Ricardo Allen and Keanu Neal as well.

As for Dan Quinn, billed as the great defensive mind, his legacy in Atlanta will simply be his defenses were at best, flawed and at worst, ie: now, absolutely awful. Coach Quinn fired two defensive coordinators. Richard Smith was followed out the door by Marquand Manuel,three if you include Quinn himself. But Quinn’s constant tampering on that side of the ball proved fatal.

The offensive side of the ball at least had some highs during Quinn and Dimitroff’s tenure mainly thanks to quarterback Matt Ryan and in 2016 Kyle Shanahan. When Kyle Shanahan departed for the 49ers the Falcons made the strange choice of Steve Sarkisian for Offensive Coordinator. After a disastrous first season (don’t mention the ‘jet sweep’), Sarkisian started to make significant strides in 2018. The powers that be decided to replace the Offensive Coordinator with a former failed head coach in Dirk Koetter, who runs a different scheme altogether, but asked him to run the same scheme input by Shanahan and was on the way to being mastered by Sarkisian. Answers on a postcard, please.

It is safe to put Dirk Koetter in the failed experiment bracket but for now, Koetter has survived the mini purge but surely, it’s just a question of when not if.

Make no mistake about it, Quinn made scapegoats out of Manuel and Sarkisian and by doing so made the team worse off.

So where do the Falcons go from here?

This is a question that will provide many more questions and as it stands very few answers. Let’s just say that the new general manager has some big decisions to make and almost all for the longer term.

According to the reliable Spotrac.com, the Falcons will start the next league year $27 Million OVER the cap using the current league cap figure of $195M. However, due to the COVID 19 pandemic and the obvious loss of revenue that goes with it, it is strongly believed that the cap figure will come down by $20M to a total of, $175M. All this means that Atlanta will start the year some $47M OVER the salary cap.

It certainly seems that Thomas Dimitroff was simply playing with house money, playing one season at a time with no thought to the overall future of the roster. The actions of a man on borrowed time but now it will be someone else’s problem to fix and some very tough choices need to be made.

So, how do you begin to solve this rather large conundrum?

You are $47M over the cap, you can’t re-sign any of your own free agents (all 22 of them) let alone sign anyone else’s and you have no money for your next draft class. In short, you need to save somewhere in the region of $70M to get it all done and still scrape by the skin of your teeth.

The combined cap hit for Matt Ryan ($40m) and Julio Jones ($24m) in 2021 will be $64M like I said tough choices. Financially this seems like the best place to start. But realistically, would Atlanta need a shot at drafting Trevor Lawrence or Justin Fields in order to cut ties with Ryan? Perhaps another quarterback can emerge the way that Joe Burrow did last year.

Trading Julio Jones would not make the new regime immediately popular with the fanbase but getting a first-round pick and clearing a good chunk of cap space would be a very good start.

Who else is for the chop and what could it save?

James Carpenter $6M
Deion Jones $12M
Allen Bailey $6M
Tyler Davidson $4.6M
Isaiah Oliver $1.5M
Deadrin Senat $1.5M

Cutting or trading all of the above done correctly could save $60M. Deion Jones will probably survive based on the makeup of his contract (the Falcons have a better potential out in 2022). Jones has declined in the last two years but can still turn himself around under new management. The best possible scenario for Jake Matthews at this point is a restructured contract that would cut that cap hit in half. I see no reason to keep anyone else on this list around.

What about the free agents?

Keanu Neal, Takk McKinley, and Damontae Kazee, Alex Mack, Todd Gurley, Brian Hill, and Younghoe Koo are the highest-profile players that are due to be unrestricted free agents. Mack’s replacement has already been drafted. McKinley’s option was not picked up and he is likely gone as is Neal. Gurley will be the most difficult decision to make both money and contract lengthwise assuming he wants to stay.

So who gets fix this mess?

Earlier this week, I ended my 2020 State of the City address by recognizing that this November’s election is so consequential it could chart a new path for our state and our nation. I meant it.

I hope you’re as fired up as I am about this Presidential race, and how proud we can all be to vote for native Oaklander Kamala Harris for Vice President along with Joe Biden.

If you’re too shy to phone bank, www.voteforward.org is an easy way to send personalized, nonpartisan letters out to simply encourage folks to vote.

And there are some transformational California Measures on the 2020 ballot! I’m most excited to vote for Schools & Communities First – Prop 15! It will close corporate property tax loopholes to reclaim nearly $12 billion every year for schools and vital services for our local communities, while protecting residential properties and small businesses. (In fact, with Prop 19 seniors and disaster survivors will have more residential property tax protections than they have today). We also need Prop 16 to pass, so we can consider diversity and racial equity in public decisions and level the playing field. And to advance criminal justice reform, vote for Props 17 & 25 and against Prop 20.

I’m also super passionate about electing Derreck Johnson for At-Large City Council – as is Kamala Harris. A 3rd-generation, gay, African American Oaklander raised by a single mother in the Acorn housing projects, he graduated from an HBCU and started House of Chicken & Waffles in Jack London Square, where 70% of employees have been formerly incarcerated. He’s the former Chair of Oakland’s Workforce Development Board and in 2012 Congresswoman Barbara Lee presented him with the City of Oakland’s Citizen Humanitarian Award. His life experiences are particularly needed as Oakland meets this moment to advance racial justice and help our economy recover.

Since Oakland created the At-Large seat 40 years ago, it has never been held by an African American. Its current incumbent Rebecca Kaplan has made budget proposals deemed “reckless” and “designed to appease special interests.” She tried to kill Oakland’s Department of Transportation, which not only is fixing Oakland’s broken and dangerous streets, but is nationally recognized for its commitment to equity. And the East Bay Express criticized her for a “shady political campaign” and “poor decision-making” which “raises concerns about her ethics.”
Here’s my complete Voter’s Guide:
I’m supporting all of Oakland’s Congressional, State and Special District Board incumbents, with the exception of challenger Jean Walsh for AC Transit.

The Oakland Police Department is pleased to share the 2019 Report on Stop Data with our Oakland community. This report fulfills OPD’s yearly requirement to release the prior year’s Stop Data. OPD continues to be a leader in Stop Data collection and exceeds the requirements of California Assembly Bill 953. OPD is proud to be the only department in the State of California who collects Intel Led Stop Data, which requires officers to clearly explain if the stop being made is associated with any current criminal activity.
Our partnership with the Oakland community is critical to the success of OPD’s work to improve the quality of life in our City. Historically, OPD collected Stop Data and made it available to the public in an effort to be transparent. OPD’s commitment to identifying and addressing racial disparities in traffic enforcement has not waivered.
The data found in this report reflects our intentional efforts to practice fair and impartial policing. The significant reduction in traffic stops on our Black and Hispanic community members reflects your police department’s work on reducing the adverse impact law enforcement contacts can have on our under-represented community members.
OPD has long been a leader in the country collecting and analyzing Stop Data. Our efforts have focused on reducing the impact of disparity to our vulnerable communities through the use of this data. This use of collected data is one of our efforts to ensure the practice of fair and constitutional policing and the reduction of racial disparity in our enforcement efforts.
Please note that while OPD has routinely collected and analyzed more data than required by AB 953, the Bill created a need for us to change some of our past data collection methods. We will continue to produce, analyze, and share data with our community that reflects the focus of OPD’s work toward transparency and fairness.

School is Ready to Welcome Students When District Reopens for In-Person Learning

Oakland – On Friday, October 9, OUSD is celebrating a major milestone in the form of the completion of a rebuilt school. The freshly completed Glenview Elementary, which sits at the corner of La Cresta Avenue and Hampel Street, is now ready to welcome students back to class once conditions related to the pandemic allow the District to reopen for in-person instruction. The school was almost entirely torn down in 2016 for the rebuilding project. The only thing that remained was the facade on the front of the school. And there are lots of other amazing features.

The old school building had undersized and under-equipped classrooms, but those are history. The new building has high-performance classrooms that are right-sized, healthy and comfortable, and achieve 21st century goals for learning environments. The retention of the iconic porch and portico element was pivotal in the design of the new building. The architect said that while it was challenging, it anchored the new building in the same location as the original building and allowed for the cherished stairs, outdoor terraces, and architectural landmark to remain.

The new multi-use room with a stage and a basketball court will be enjoyed by students, parents and the community, and the roll-up doors allow larger indoor/outdoor gatherings. The library’s location and design with its built-in amphitheater seating, flexible layout, and restroom support school and community use.

The school was also built with sustainability as a major driver of the design. The school is resource conscious, consumes less energy, and provides natural lighting throughout. It is well-insulated, has efficient radiant heating systems and LED lighting, ceiling fans are used for cooling and comfort, windows are operable and energy management systems were installed to manage energy consumption.

“This is a moment we have all been waiting years to see,” said Superintendent Kyla Johnson-Trammell. “A time when we get to celebrate the rebirth of a beloved school. The newly rebuilt Glenview Elementary will serve generations of Oakland children, as a warm, welcoming and supportive environment for learning. It is beautiful inside and out, and any Oakland student would be proud to call Glenview their school. Likewise, the campus will serve as an important community center for residents in the Dimond Park area. We thank the taxpayers of Oakland for supporting this important work to ensure our students have the kind of learning environment that all young people need and deserve.”

Second Highest for Any NFL Regular Season Game on Record​

New York – Thursday’s Thursday Night Football Presented by Bud Light Platinum game featuring the Chicago Bears’ 20-19 win over the Tampa Bay Buccaneers was seen by an average audience of 15.4 million across all platforms, including FOX, NFL Network, FOX Deportes, NFL digital, FOX Sports digital, Amazon Prime Video, Twitch and Verizon Media mobile properties.

The 15.4 million viewers for Buccaneers-Bears across all platforms is up +3% versus last year’s Week 5 Thursday Night Football matchup between the Los Angeles Rams and Seattle Seahawks (15.0 million).

The Nielsen-measured audience was 14.8 million – up +2% versus the 2019 Week 5 Thursday Night Football game (14.5 million).

Digital streaming across Amazon Prime Video, Twitch, NFL digital, Buccaneers and Bears mobile properties, FOX Sports digital and Verizon Media mobile properties produced an average minute audience of 1.33 million – the second highest for any NFL regular season game on record, behind the 2019 Week 4 Thursday Night Football matchup between the Philadelphia Eagles and Green Bay Packers (1.4 million). Additionally, digital audience increased +27% versus the 2019 11-game FOX Thursday Night Football average (1.04 million) and +5% versus last year’s Week 5 Thursday Night Football matchup (1.27 million).

Amazon Prime Video and Twitch alone reached a total of 3.3 million combined viewers worldwide for the FOX NFL Thursday pregame show and the Buccaneers-Bears game. For the Buccaneers-Bears game alone, 2.9 million worldwide viewers initiated a stream on Prime Video or Twitch. The average worldwide audience watching the Thursday Night Football game for at least 30 seconds on Prime Video or Twitch was 746K.

Re-Elect Rebecca Kaplan Over Sidebotham, Johnson For Oakland City Council At-Large In 2020

In the 2020 Oakland Elections, Oakland City Councilmember Rebecca Kaplan is facing a major challenge from friend and perennial campaigner Nancy Sidebotham, and newcomer Derreck Johnson.

Nancy is an incredible member of the Oakland political world, but her main advantage is in pointing out problems, less than offering solutions. I like Derreck Johnson, and his run represents a need for more black male participation in Oakland politics. That said, he has no previous Oakland political experience at all, and no knowledge of municipal governance. As much as his efforts and his errors in business are good teachers for him, and for anyone entering politics, and draw media racism he’s not ready to lead Oakland at this point in time, Moreover, he’s the latest manchurian candidate offered up by my godsister Oakland Mayor Libby Schaaf. Libby should just work to make friends with Rebecca. I’ve said that before, I’ll say it again.

Anyway, when I think of Rebecca, I think of what I contend is her signature, lasting effort. The one that shows good Oakland City Council work in action: The Broadway Free Transit Shuttle that’s now an Oakland institution.

I also think of the many ideas she’s formed to help Oakland’s budget, as well as the many, many small efforts she has made to ease the lives of Oaklanders. It does not matter if it’s a City Council motion that passes, or co-authoring legislation to get Oakland’s speeding problem under control, the fact is, the total number of legal changes she has made for Oaklanders has not been effectively chronicled. The point is, experience matters.

The Oakland City Council faces the very real prospect of having a membership consisting of no one with over one year of experience. And that’s in the middle of a Pandemic. Rebecca must be re-elected to assure the maintenance of institutional memory, so that current political biases don’t cause a misunderstanding, and there fore a mishandling, of government. How to work with Oakland City Staff is more important than anything. Hiring the right people to represent the councilmember is equally more important than anything. We’re in the dark with Derreck Johnson, and even my friend Nancy Sidebotham – but not with Rebecca Kaplan, the Oakland City Council President.

With all of that, why is Rebecca opposed? Well, I will say that she gained the backing of the Democratic Party, as well as a list of notables the party pointed to: “SEIU Local 1021, the Sierra Club, Block by Block Organizing Network (BBON), Former State Assemblyman Sandre Swanson, California Nurses Association (CNA), Firefighters Local 55, Northern California Carpenters Regional Council, Black Women Organized for Political Action PAC, Asian Pacific American Labor Alliance (APALA), Alameda Labor Council, Alameda County Building Trades Council, Sprinkler Fitters Local 483, Former Mayor Elihu Harris, Vice Mayor Larry Reid, President Pro Tem Dan Kalb, Councilmembers Sheng Thao, Nikki Fortunato-Bas and Noel Gallo, Oakland Port Commissioner Michael Colbruno, Founder of She the People Aimee Allison, Pastor J. Alfred Smith Sr., Reverend Harold Mayberry, California Young Democrats National Committee Representative Igor Tregub, Cat Brooks, and many more endorsing Rebecca Kaplan.”

I add myself to that list, and I am proud to endorse my long time friend. Rebecca and I have three things in common: first, we’re both ostracized to some extent for being ourselves, me as a straight, black, tech-oriented guy with a Jewish last name who “talks white”, she for being butch lesbian and Jewish. Then, we’re both urban planning and economics grad school grads from MIT for her and Berkeley for me, and we both love Oakland.

Vote for Rebecca Kaplan.

The Oaklandside, a new online publication by the person who owns Berkeleyside and that has a $3 million grant from Google, owes Derreck Johnson, a candidate in the Oakland City Council race for the At-Large Seat occupied by Rebecca Kaplan (who I endorsed), an apology (and just maybe a chunk of that 3 million). It’s recent post attacking him for filing bankruptcy was nothing short of racist in my view as an Oakland black media entrepreneur in the time of George Floyd and Breonna Taylor.

UPDATE: As I wrote here, this must be reported:

In this case, some who are white, just could not accept that my actions were out of anger for the racist Oaklandside post, and first assumed that I was backing Derreck Johnson, when I openly said I was supporting Rebecca Kaplan, and then, on their own, guessed that Derreck, Mayor Schaaf, and I all went to Skyline High School together.

When a friend of mine who’s white texted me with that question about Skyline High School (where I am Class of 80 and Libby is Class of 1981), I called and let him know how upset with him I was. I said “You can’t accept the fact that my concern for what was written about him was purely because I perceived it as racist, huh? Do you realize that’s racist?”

As my friend is prone to do, he laughs nervously and tries to change the subject, but this time I kept focus. The problem was the Oaklandside post was truly institutionally racist, and it doesn’t matter what a person thinks to the contrary, even if they’re black. In Oakland, too many of us black folks are too willing to put down someone else black anyway – it’s a crabbarrel problem of massive proportions that helps no one.

The fact is that, according to Derreck himself, he went to Bishop O’Dowd High School, not Skyline High School. And so that leads back to my point: the desire to not see a racist act and deflect eyes from view keeps it as justifiable. That’s what my friend was trying to do, and he needs to stop doing it. As I said to him “We can’t allow a point of view like yours to fester because, little by little, these racist stories build up, until we get George Floyd all over again.”

No more racial profiling in media. If Derreck’s run has done anything, it’s shown a spotlight on that problem. It has to stop.

Donald Trump’s Businesses Have Filed For Bankruptcy Many Time Yet He’s Considered Successful

The Washington Post reported that Donald Trump’s businesses filed for bankruptcy six times. In all of the media coverage, no reporter or columnist ever blasted Donald Trump for bragging about his success. By contrast, Derreck Johnson’s business filed for bankrupcy and here is the Oaklandside’s Darwin BondGraham (and its editors hiding behind him) to say he’s not successful. Johnson is black. Trump is white. There should be one standard of fact: both started and ran businesses that employed people. And in Johnson’s case, he gave black men and women out of prison another chance at life. That’s successful.

And, as a momentary aside, I’m proud to report that Zennie62Media’s OaklandNewsNow.com that you’re reading is twice the size of Oaklandside in online traffic, and with a fraction of it’s budget. And it’s black owned and operated, whereas Oaklandside has a black editor, but is white owned, and the person who wrote the post is white and male.

Oaklandside’s Attack On Derreck Johnson Reflects A Classic Pattern Of Media Racism

Anyway, Oaklandside accused Derreck Johnson of being so proud as a black man to run television commercials saying he’s “successful”, that he needed to be taken down a notch by getting out “the truth”. The truth as Oaklandside saw it. The truth as Oaklandside was presented with by a source. I say that because I know where the information came from, and who gave it to Oaklandside, regardless of what it claims. Moreover, it’s no secret: bankruptcy information is publicly available, folks.

What Oaklandside did was simply make phone calls around town to form a story around the information it was given. If Oaklandside were truly interested in “the truth” it would have produced an article with information about the businesses of all of the candidates, without sensationalism. If Oaklandside was were truly interested in “the truth”, it would have worked with Mr. Johnson to run a positive story about what problems he experienced as a black man keeping his business going.

The story Oaklandside’s racist lens caused it to miss was one that needs to be told at a time when everyone from Facebook to Google has some kind of initiative focused on financing black businesses, in the wake of George Floyd and Breonna Taylor. Think about it. As Marcus Burke put in for The World Economic Forum “Following the murders of Breonna Taylor, George Floyd and many other Black people at the hands of police, companies have started to take a stand against systemic racism.” Obviously, Oaklandside showed itself to be completely tone-deaf to the times.

In the paper “Media Representations and Impact on the Lives of Black Men and Boys”, by the Topos Partnership with The Opportunity Agenda, the authors observe:

A robust body of research documents how the overall presentation of black males in the media is distorted in a variety of ways, relative to the real-world facts. While individual studies tend to focus on a single genre or medium — such as TV fiction shows, magazine advertising, or video games — the research taken as a whole reveals broad patterns, including:

Negative associations exaggerated — particularly criminality, unemployment, and poverty. The idle black male on the street corner is not the “true face” of poverty in America, but he is the dominant one in the world as depicted by media.
Positive associations limited — particularly, sports, physical achievement in general, virility, and musicality. While the media’s version of America is populated by some black males intended to inspire, they tend to represent a relatively limited range of qualities to the exclusion of a variety of other everyday virtues.
The “problem” frame — Due to both distortions and also accurate and sympathetic discussion, black males tend to be overly associated with intractable problems.
Missing stories — Many important dimensions of black males’ lives, such as historical antecedents of black economic disadvantage and persistence of anti-black male bias, are largely ignored by the media.

In Derreck Johnson’s case, Oaklandside missed a great chance to have him tell his story of what led to the problems he experienced with his business. Moreover, Oaklandside worked to, as the authors wrote about media bias against black men, “Negative associations exaggerated — particularly criminality, unemployment, and poverty.” In other words, the Oaklandside’s seems to be upset that Johnson didn’t say he had been in financial trouble. Note, Johnson didn’t break any law, so that was the best it could do in attacking Derreck Johnson.

The Times Are Changing – The LA Times

In these times, America is beginning to wake up to the media racism that has worked to constantly paint blacks in a negative light. The kind of media racism that has been active in Oakland and San Francisco Bay Area media for far too long. And, let’s face it, the kind of media racism that was served up to feed the desires of some in Oakland who are white for the most part, and just don’t want to believe anything positive about anyone black who dares say they’re successful, or holds a title. Those persons want to push blacks into the familiar image of being poor, downtrodden, and criminally inclined. The kind of media The Oaklandside produced makes them oh so happy. Sad stuff that must stop.

In that, I must say it’s great The Los Angeles Times called out its own history of racism.

But, even then, The Los Angeles Times leaves out the racist lens that’s still applied today, and one that Oaklandside uses. Moreover, one would think that other mainstream media news publications would follow the Los Angeles Times’ lead, (like The San Francisco Chronicle, which has its own problems with racism as one can see here, and here, too.) but to this date, crickets. For many who are white, racism only exists when the n-word is used or a black person is physically harmed. But real racism is evident in all aspects of life, and in many ways, and in media, it’s expressed in how blacks are portrayed.

As I saw it, here’s the truth: Derreck Johnson did establish and run a business in Oakland that employed people, most notably black ex-prisoners who needed help. Stop it right there: that’s the success story that should be told, and that Derreck has the right to crow about. It’s clearly a story Oaklandside didn’t even think to try to tell, even though it was starring them in right in the face. Oaklandside was way too focused on putting a cyber-knee in Derreck Johnson’s online neck.

I got wind of this via a phone call from a friend. I called Derreck Johnson and we talked extensively. I told him that my first introduction to him was from an email from Oakland Mayor Libby Schaaf. I said it wasn’t the first time my godsister advanced a candidate to challenge Councilmember Rebecca Kaplan. I also told him that, for those reasons, I thought of him as a Manchurian candidate. He laughed and understood and because I gave him a video platform to talk about running for office and about himself. I never sought to put him down. Blacks in America have had enough of media racism.

Unlike Oaklandside, I asked and gave Derreck Johnson a chance to tell his story:

Oakland – On Thursday evening, October 8, an important partner to Oakland schools and our students is holding its annual fundraiser. The Oakland Lacrosse Club (OLC) is hosting a virtual fundraiser to raise money to help it serve its student athletes. Every year, OLC shares the sport of lacrosse with 2,500 OUSD students, and 175 sixth to twelfth graders participate in the year round program.

The money raised will help OLC support the creation of girls varsity lacrosse programs at every OUSD-run high school, provide intensive college counseling for 100 high school players, and continue to build a 6th to 12th grade pipeline offering the sport of lacrosse to all youth in Oakland public schools.

Lacrosse is a sport similar to soccer played on the same kind of field, yet with a small rubber ball that is thrown back and forth between players using sticks with nets on one end. The boys version is full contact, so they wear helmets and pads. The girls game has contact similar to basketball, so they don’t wear helmets or pads, but they do wear safety goggles. The sport is a descendent of what was called baggataway, which was invented by Native Americans in the 15th century. Oakland Technical High School has had a girls varsity team and a boys club team for several years, and girls varsity teams are coming to Oakland High and Skyline High, the latter of which used to have a boys varsity team.

Like every organization, Oakland Lacrosse has faced challenges because of the pandemic. Undaunted, OLC created a fall program in which 10 coaches oversee 60 players and provide weekly check-ins on academics, wellness and fitness. Players can join the coaches at social distance lacrosse and fitness workouts around the city so they have the opportunity to exercise and connect with their teammates. OLC also partnered with ESM prep to provide intensive college counseling for high school juniors and seniors, half of whom will be the first in their family to go to college.

The fundraiser is free to attend, and will include an awards ceremony. OUSD Communications Director, John Sasaki, who is a lifelong lacrosse player and current high school coach, will serve as emcee.

Oakland News: A letter was passed to me moments ago that outlines the interest of the African American Sports & Entertainment Group in purchasing the Oakland Coliseum site for $92 million. The group consists of Ray Bobbitt, who spearheaded the African American Oakland NFL Expansion effort, which is part of this group’s focus, famed sports agent Bill Duffy, who was also part of the Ronnie Lott Group development team that tried to retain the Raiders in Oakland but lost them to Las Vegas, Oakland developer Alan Dones, former Oakland City Manager and one of my mentors Robert Bobb, and Chicago’s Loop Capital, where a family friend of mine, Darrell Williams, is good friends with former President Barack Obama, and is in the photo below with Loop Capital’s Chief Executive Officer Jim Reynolds.

Dear Mayor Schaaf and esteemed Oakland City Council Members,

The African American Sports & Entertainment Group (“AASEG”) has been working over the last several months to lay the groundwork for bringing a National Football League (“NFL”) franchise back to Oakland. One of the critical factors in our ability to attract a new NFL franchise is a viable home field location for the team. As well, we recognize the interests of city leadership in the holistic redevelopment of the Coliseum area consistent with the vision articulated by the 2015 Coliseum Area Specific Plan. We also recognize the City of Oakland’s interest in maintaining a home for its Major League Baseball (“MLB”) franchise, the Oakland Athletics. We believe that all these objectives can be achieved and to these ends, we have assembled a Master Development Team well-capable of marshalling the resources and expertise necessary to transform our mutual interests into reality. Our team, described as the “AASEG Team”, is pleased to submit this non-binding, indication of Interest, proposal to purchase the City of Oakland’s interest in the Coliseum property for a total of Ninety Two Million Five Hundred Thousand Dollars ($92,500,000), payable per the schedule provided in Exhibit A.

In addition to the enormous community support for our mutual vision, AASEG has assembled a Master Development Team fully capable of executing the development of the Coliseum property (the “Project”).

▪ BDA Sports Management – Led by respected sports agent Bill Duffy, BDA is one of the world’s top ranked sports agencies focused, specifically on basketball. Bill has agreed to apply his extensive network and decades of experience toward execution of the Project, including assembling some of the leading names in sports and entertainment in support and endorsement of the Project. Bill was one of the architects of the Ronnie Lott/Fortress Capital plan that offered a viable option to build a stadium on the Coliseum site.

▪ Strategic Urban Development Alliance – One of Oakland’s largest African American real estate development firms, SUDA has executed millions of dollars’ worth of projects in the Bay Area. SUDA Chief Executive Officer, Alan Dones, has led development projects both in the United States and Africa. He will provide development consulting to the Project.

▪ The Robert Bobb Group, LLC – With specialty capabilities in economic development, urban planning and community and neighborhood engagement, RBG is an African American owned national consulting firm to both public and private sector clients. Chief Executive Officer Robert Bobb will provide consulting services to the Project.

▪ Loop Capital – The largest African American owned, full services investment banking brokerage, financial advisory and investment management organization, Loop Capital boasts a 23-year history of developing financial solutions for America’s largest public sector institutions and private sector firms. In addition to its global capital markets, Loop Capital is an experienced advisor on Public-Private-Partnership and infrastructure transactions. As well, Loop Capital is part of a team developing a 100+ acre parcel owned by the City of Chicago and the Metropolitan Pier Authority. Finally, Loop Capital’s Chief Executive Officer Jim Reynolds is a partner in JLC Infrastructure, a private asset manager with over $800 million under management targeting investments in various publicly owned assets. Loop Capital is the capital partner for the Project.

Stakeholder Interests

The AASEG Team is well aware of the aspirations of the citizens of Oakland and other stakeholders with respect to the Project and is prepared to engage the City as a partner in the execution of a mutually-agreed upon vision embodied in a Community Benefits Agreement that includes:

• Local hiring with priority on racial equity

• The engagement and inclusion of local and small business contractors
and businesses

• Environmentally friendly landscaping and sustainable, energy efficient
design

• Anti-displacement assistance and housing preservation policies for
residents in the development area

• The inclusion of affordable housing

• Project Labor agreements and labor peace

• Local employment and job access provisions, workforce training,
retention of existing workers, and apprenticeship policies

• Living wages, benefits, and stable employment opportunities

• Environmental mitigation measures

• Open space elements

• Sustainable and healthy development

• Transportation infrastructure and transportation demand management
programs, including transit affordability and accessibility

• Potential impact fee’s (housing, transportation, capital improvements)

• Other community benefits as needed and feasible, to be negotiated

Finally, we are keenly aware of the interests of the Oakland Athletics organization in a second option for a baseball stadium should current objectives not come to fruition. The AASEG team is prepared to maintain development space in the Project toward those ends and looks forward to engaging the A’s to fully understand and address their interests.
The AASEG Team is excited to work with the City of Oakland to develop a definitive agreement for the purchase and Master Developer control of the Oakland-Alameda County Coliseum complex and is prepared to engage staff and leadership to craft an agreement that reflects the provisions in this indication of Interest. We are eager to begin due diligence activities and formal discussions upon the City of Oakland’s acceptance of this non-binding offer. We believe that this historic undertaking will be a perfect example of the African American community being supported by the larger community in achieving economic equality. We are extremely grateful to be in a position to provide jobs and housing for the citizens of Oakland, and to continue to provide world-class sports and entertainment facilities for the entire East Bay region.

As America wrestles with social change, social justice, and economic justice, Oakland can lead the way in demonstrating what real impact is. As proud Oaklanders, it is a part of our DNA. It is simply who we are, and what we do best. We look forward to helping lead that change in the City of Oakland.

Again, with respect to the NFL, the same lawsuit that Ray Bobbitt invested $40,000 to start and against the former Oakland Raiders now Las Vegas Raiders and the NFL is not only still active, but restarts October 8th. For the group to have a snow-ball’s chance in hell with the NFL, that lawsuit would have to be dropped.

That said, if the group can gain some kind of joint control with the Oakland A’s, then the prospect of the NFL returning to Oakland becomes that much more realistic. Why? Because they will have control of land to build a new stadium for an NFL expansion team, or an existing organization.

Oakland Public Ethics Commission Complaint On Lane Partners Not About Lynette Gibson-McElhaney

This Oakland Public Ethics Commission Complaint comes under the subhead-line of ‘bone-headed reports by fake news folks with racist agendas” and refers to an Oakland Public Ethics Commission Complaint that was filed against a firm called Lane Partners, represented by Andrew Haydel. The matter was before the Oakland Public Ethics Commission, and in it’s agenda for October 5th 2020.

What happened was that Lane Partners was encouraged to make a contribution to the Lynette Gibson-McElhaney Legal Defense Fund, and not by anyone directly connected to Lynette, but by, according to PEC records, my friend (at least I think we’re still friends, but in this town shit gets weird for weird reasons) Greg McConnell, the founder of the Oakland Jobs and Housing Coalition. A 2018 email reported McConnell’s plan to get donations for her 50th Birthday.

And Now This Aside…

Now, if you go an assume that Lynette herself established that plan, then you know less about Oakland politics than you think, and are contributing to the crab-barrel, game-playing that causes Oakland to lose out big on matters like retaining sports teams. Oakland has a major-league loser mentality that has to be addressed. Character assassination is sport in Oakland and I find that it’s a proxy for professional competence. But that aside, there are any number of political players in Oakland and San Francisco wiling to, what we call on the streets, “run a game” on someone. Some of them rest in the media.

Seriously, there are some media-types who live for documents that make black Oakland elected officials look bad, but when the elected official is white, they look the other way. Want evidence? Go back to 2013 and the claims of Oakland City Staff Tampering that were leveled against Oakland Councilmember Larry Reid of District 7 and Desley Brooks of District 6 – claims that, as former Oakland City Councilmember Ignacio De La Fuente will tell you, apply to every Oakland City Councilmember in history. But when the white media got involved, they didn’t want to see that, and just saw a chance to paint black elected officials as bad, and so they did.

The trouble with a lot of black folks here in Oakland and in America is they complain about the white media types but are by inaction afraid to counter them, and don’t back black media. And so we get the social climate painting black folks so negatively that the result is George Floyd’s death.

The Los Angeles Times recently took itself to task for decades of racism, but I was waiting for San Francisco Bay Area white mainstream media to follow its lead. I’m still waiting and I’ve made some accounts in the process.

Anyway Back To The Action, I Mean The Oakland PEC Complaint

The Oakland PEC Complaint about Lane Partners reads, in part, this way:

Respondents violated the Oakland Campaign Reform Act by contributing $1,000 to Lynette Gibson-McElhaney Legal Defense Fund in October2018 at a time when they were subject to the City’s ban on contributions from City contractors to candidates, in violation of Oakland Municipal Code section 3.12.140

And here’s the rest:

In June 2019, Commission Staff initiated a pro-active investigation after Andrew Haydel’s lawyer called to report that Haydel, a commercial real-estate investor and principal at Lane Partners LLC, “may have made a contribution” to an Oakland political candidate’s defense fund during a time when he and Lane Partners, a City contractor, was subject to the contractor campaign contribution ban.
Between 2016-2018, Lane Partners was involved with several different development projects with the City of Oakland. One such project was the Eastline project.

PROCEDURAL FACTS:

The Respondent and Staff reached a settlement agreement in February 2020. Staff prepared a Stipulation recommending that the Public Ethics Commission (PEC) impose a penalty of $2,000. In the Matter of Haydel was scheduled on the PEC’s March 2020, Agenda. At the PEC’s March meeting, the Commissioners rejected the recommended penalty of $2,000 and instead informed the Respondent that a $5,000 penalty was a more appropriate penalty based on the facts and experience of the Respondent. The PEC instructed Staff to renegotiate the Stipulation with a penalty of $5,000. Staff reached out to the Respondent who initially agreed to sign a revised Stipulation and pay the increased penalty of $5,000.

As a note, this is way not the first time Lane Partners has made a donation that was viewed as having violated Oakland’s Campaign Reform Act, but the simple fact the PEC caught this means good for the future. I must also report that there have been so many alleged violations of the type that Lane Partners is accused of, that it may be time to revisit the law from the perspective of laws that cause entrapment. Because one can replace Lynette Gibson-McElhaney with the Mayor or any other Oakland City Councilmember, and some idiot with a keyboard (who may be running a smear campaign on behalf of another Oakland City Councilmember) would jump to the conclusion that Libby did something wrong, when she had nothing to do with the action.

Anyway, it goes on to report via documents like this one that Lane Partners acted on the advice of their lawyer, Zack Wasserman (Another long-time friend of mine who now former Oakland City Attorney John Russo used to call “Zack-A-Potatos”). Wasserman is asking for the PEC to consider his error to his client, and also for the standard $5,000 fine to be reduced to $2,000, and Lane Partners would pay it.

And there’s the real story. A true mistake admitted to.

The point of all of this: it’s really important to look before one takes any leap and makes negative assumptions about someone else. Also, some electeds in Oakland should be real careful about passing information they deem negative about someone else. After a time, that crap will back fire. God does not like ugly.

In Defense Of Bill Clinton And Joe Biden: The Truth About The Need For The 1994 Crime Bill

Former President Bill Clinton has come under intense attack for his full-throated defense of the crime bill of 1994 what is really called the violent crime control and law enforcement act of nineteen ninety four. It seems to me that the people who are talking (even the pundits on for example MSNBC Joy Reid, for example, and others) either weren’t really paying attention then, or and didn’t read the crime bill, or perhaps read the crime bill and forgot what it consisted of, and forgot the events that gave rise to its creation and passage.

Let me share with you but one of those events. July 1st 1993 was really a bright sunny day in San Francisco and afternoon about one o’clock and i went to the Royal Exchange to hang out early at the great Cal bar (for University of California at Berkeley students like myself, I got my master’s degree in city planning from Cal was on the Alumni Board from 98 2001 1998-2000 actually 2003 but I digress).

Bottom line is it was a great day but the television / switched to KTVU Channel 2 because just around oh three o’clock or so at that time there are reports of a shooting at 101 California Street.

Now to give you an idea where 101 California Street is with respect to wear Royal Exchange is. Royal Exchange is on Sacramento at Front Street here. If you go down Front Street, this is California. 101 California is right there, so basically just go down the block across California over here and the giant skyscraper that is 101 California is right there designed by Phillip Johnson – a steel and glass, iconic skyscraper that , when it was proposed, was unlike anything San Francisco had seen before. That’s another story.

A man by the name of Gian Luigi Ferri went up to the 34th floor to a law firm called Pettit and Martin. He got off the elevator and started to randomly shoot people using assault weapons.

There was a woman that I knew from Cal who worked at Pettit and Martin as associate. Just started, did Terry Presite, and I was worried for Terry. I was able to call her but couldn’t get a hold of her. Gian Luigi Ferri walked through her office and eventually killed nine people, injured seven others, ruining the lives of many, and impacted lives of countless people forever.

Pettit and Martin closed in 2001. That event, and others like it, gave rise to a call for a sweeping crime bill in 1994. A 363 page document that was sweeping far-reaching in scope – so for anyone to say that it negatively impacted the black community like the black folks all did did all this stuff really doesn’t know what they’re talking about to begin with.

For example, do you realize that the Violence Against Women Act started with a 1994 Crime Bill with a with the same bill that many are criticizing? Do you realize that the start of funding for halfway houses for escape places for victims of domestic violence started with the crime bill? Do you realize that the 1994 Crime Bill had an assault weapons ban that we have not had the collective will to establish today in an era of mass shooting after mass shooting after mass shooting?

Do you realize that? Do you realize that the that same bill that Bill Clinton is getting so much negative publicity for is the same bill that put 1,000 cops on the street? That funded and gave rise to community policing? They had a provision within it that said the US Justice Department was supposed to give an annual report on the use of excessive force by police programs around the United States – something that was never done.

So have you ever bothered to read the damn bill? No, you have not.

Do you realize what was going on at the time? No you don’t.

It made Oakland a safer community. It allowed us to hire more cops. It allowed us to get assault weapons off the street. We had gun buyback programs – including that, it was really effective.

The main overarching problem then in the 90s drugs were considered to be a problem of the black poor okay particularly heroin drugs weren’t thought of as being a white problem, even though all we knew we knew white folks did drugs and marijuana, but it was thought of as being a black problem.

Today, drugs are thought of, particularly heroin, as being not just a black problem but a white problem – which means it’s everybody’s problem. So now the 1994 crime bill that was so good then, because it only focused on drugs and you know black and the idea was that holy focus on black folks is now today thought out by some is being bad because hey white people new use drugs and right folks have a problem.

So now we’ve got to decriminalize everything.

You see what I’m getting at? It was okay to criminalize it when it was focused in the black community, but now that it’s a white problem oh we have to decriminalize it. Think about it. Think about what I’m saying to you. Think hard about what I’m saying to you, and at the same time we don’t have an assault weapons ban.

And you know something else that came out of the Violence Against Women Act which is still active: The Cyber Crimes Act, the act to prevent cyber bullying, which is installed in 2005 as a rider provision,

Do you know what you’re talking about when you criticize this bill? Yes there are parts of it that should not have been there, but given the climate of the times they were appropriate. Given what was happening in then they were appropriate. And again, it did sunset.

The real problem we have not solved since then is we still have an assault weapons problem. In fact, it’s enormous. We have open carry laws that people are openly defending in Georgia, walking around airports with their assault weapons saying oh this is okay at a time when terrorism is a concern, a big one, including domestic terrorism.

So in this context you’re going to tell me that the 1994 crime bill was this terrible thing? I think you need to reassess what you’re talking about, you really do.

Phil and I go, as they say, “way back”, so I’m blessed to be able to present a friend who’s a giant in music, talk about the loss of Eddie Van Halen, remember Skyline High as we’re both Class of 1980, and get into the magic of The Phil Gates Band. Here’s his official bio:

Phil Gates was born in Chicago Ill., into a family of musicians that helped form his music style, and ability. Phil began playing musical instruments at the age of eight, and listening to a wide array of music has always been his main source of inspiration. Phil has played venues from small clubs, to the U.S. Air Force’s “Tops in Blue” World Tour, which performed in sixteen countries as well as the halftime show of the NFL Superbowl.

Phil has performed at many venues all over the world with his band. Also, the band was featured for five consecutive years on Hornblower Cruise’s “Friday Night Blues Dinner Cruise”.

Phil’s style is reminiscent of the early high energy Buddy Guy, mixed with a special blend of flavors from Jazz, Fusion, New Orleans, and the Chicago, Delta, and Mississippi Blues styles.

The Phil Gates Band won the “Beale Street Blues Kings” Competition in Memphis, and competed in the Blues Foundation’s International Blues Challenge.

Phil has been steady contributor to the Blues Community in Southern California. He founded the Los Angeles Blues Society, and has been a valued judge for the Blues Foundation’s International Blues Challenge in Memphis, TN, and also at many of the Guitar Center “King of the Blues” competitions in Hollywood, CA

Phil has also performed at great venues such as B.B. King’s, Cozy’s, Biscuits and Blues San Francisco, Highway 99 Seattle, WA, The Coach House, CA, The Monterey Bay Blues Festival, The Santa Clarita Blues Festival, The Topanga Canyon Blues Festival, The Simi Valley Cajun & Blues Festival, The Blues Music Awards Blind Raccoon Showcase, The Blues Nights Gossau(Blues Festival in Gossau, Switzerland), The Rock und Blues Festival in Gams, Switzerland.

Phil had the opportunity in his early years to listen and study great talent. As front of house engineer at the Caravan of Dreams Performing Arts Centre in Fort Worth, Texas, Phil worked with some of Blues and Jazz’s greatest performers to include: Buddy Guy, Stevie Ray Vaughn, Albert King, Dizzie Gilespie, Wynton & Branford Marsalis, Kevin Eubanks, Eartha Kitt, Dianne Reeves, Bobby “Blue” Bland, and many others.

In the studio, Phil has been busy working on the follow up to the successful releases of “Phil Gates Live in the Danube Delta”, “The Twelve Rhythms”, “Phil Gates Live at The Hermosa Saloon”,“Addicted To The Blues”, and “In The Mean Time…” many of which, though not nominated, were all on the Grammy Ballot in their respective years as one of a few titles in their Category.

Phil is an accomplished session guitarist, performing on such projects as the Philip Bailey CD “Life & Love”, also with artists Kellie Blaise, Billy Shields, Maurice White, Zac Harmon, Preston Glass, L.A. Stlyz and Seabron.

His session work playing guitar has included many tracks with artists such as: Peabo Bryson and Regina Belle, Melba Moore, Freddie Jackson, Evelyn “Champagne” King, Deniece Williams, Jody Watley, Howard Hewett, Teddy Pendergrass, Brian McKnight, Ruben Studdard and Maurice White.

As a Producer, Co-Produced the award winning Blues record “The Blues According to Zacariah” with Zac Harmon, and recently has been a Co-Producer on a CD project with Little Richard. Phil also Produced the “Too Much Car For the Road” CD for Toni Dodd, “Urban Legacy” CD for Julia Jordan, daughter of renowned guitarist Stanley Jordan (who also performed on the CD). Also Phil scored an AFI film “My Normal Life”. Oakland Council President Rebecca Kaplan Challenges Lyft to Debate Her

OAKLAND, CA – Yesterday, October 5th, at 10:30AM Oakland City Councilmember at-large Rebecca Kaplan, held a press conference together with a coalition of leaders, to denounce the lies of billionaires who are trying to buy our elections – both in the City of Oakland, and throughout California. Large corporations, including Lyft and Uber, are spending big in this election, seeking to undermine our democracy, harm workers, and undermine our communities, while demanding sweetheart deals and special loopholes for themselves. In this upcoming November election, they are spending big, at the local level in Oakland and Statewide in California — where they also recently gave large sums to the State Republican Party.

Rebecca challenged them to “put their mouth where their money is” and debate her. Kaplan demanded they tell the voters directly why they think they should not pay their fair share for the roads and infrastructure they rely on every day.

Said Kaplan: “Locally they are demanding special treatment, tax loopholes, and monopoly power. The big money they are spending to attack me is less than the millions of dollars they could cost the people, if billionaires get to hurt workers and community. These huge corporations are trying to undermine our democracy, for California, and locally in Oakland.”

Assemblymember Lorena Gonzalez added: “We can’t allow billionaire corporations to buy politicians and policies, either directly or indirectly. I’m standing up with Rebecca Kaplan because I know she will stand with regular folks against corporate greed. She’s already proven that, and that’s why they are targeting her.”

Gary Jimenez, Vice President of SEIU 1021 stated: “We are living in uncertain times and working families remain under attack. We cannot let large corporations continue to dump tons of money into our elections supporting anti worker politicians. I support Kaplan who supports working families.”

Sam Davis, Candidate for Oakland Unified School District Board said of this overreach, “We’ve seen how the huge expenditures by billionaires in our Oakland school board elections have corroded our democratic process, and we need to take a stand and say this stops here and now. Only by building a truly grassroots campaign, with thousands of voices, can we drown out the money megaphone that we are up against. I support Rebecca because she stands with our teachers and students.”

And Art Pulaski, CA Labor Federation Executive Officer, said: ““Oakland voters aren’t going to stand for Lyft’s brazen attempt to strip workers of basic rights, smear a champion of working people and buy elections.”

Randy Shaw, journalist and housing advocate, sent: “A company spending tens of millions of dollars to deprive workers of benefits via Prop 22 is now targeting a councilmember who has fought for increased affordability in Oakland. Prop 22 would make Oakland’s housing crisis much worse.”

Re-Elect Oakland City Attorney Barbara Parker To Protect Oakland Tenants

Since taking over for the three-times-elected Oakland City Attorney John Russo, Barbara Parker has consistently worked to protect tenants in Oakland at a time when the City’s very cultural fabric has been damaged by gentrification. One search for “Barbara Parker” and “tenants” in my email feed revealed 50 results. Time after time, news releases of actions taken to avenge tenants who’s rights were violated by landlords. This is not intended to be a tenant vs landlord post, but the fact is some of the homeless Oaklanders on the streets are there because of actions by property owners who did not give them a break, or actively worked to remove them illegally. It’s time to re-elect Oakland City Attorney Barbara Parker.

Here’s an example of what I mean:

City Attorney Wins Court Orders to Stop Owners and Operators of Oakside Independent Living from Illegally Evicting Tenants, and to Appoint a Receiver to Protect Resident Safety.

In August, I filed an emergency tenant protection lawsuit and request for a restraining order against the owners and operators of an Independent Living Facility (ILF), Oakside Independent Living, for exploiting and threatening their elderly and disabled tenants during the COVID-19 pandemic. ILFs are virtually unregulated lodging for adults who need help with daily responsibilities like meal preparation and housekeeping. This month, the Alameda County Superior Court granted our motion for emergency relief, ensuring that Oakside’s owners and operators can no longer illegally evict or otherwise harm their tenants. In addition, the Court granted our request to appoint a receiver, an extraordinary remedy to ensure the property is managed in a fashion that protects its residents.

In the past, Oakside Independent Living has subjected the elderly and disabled tenants to unsafe and unhealthy conditions at the facility, including severe infestations of bed bugs, cockroaches, and rats. The owner and operators also rented out $900-a-month converted storage spaces too small to stand up straight in as “units,” as if they are fit for human habitation. If tenants complain of poor treatment or conditions, some have been threatened with transfer to Christopher’s Care Home, another ILF managed by one of the defendants. And this summer, tenants have been evicted in violation of the local moratorium. One tenant illegally evicted from his unit described his time at Oakside Independent Living as “the worst experience of my entire life.” We are grateful the Court has taken these issues seriously and acted to protect Oakside’s tenants.

City Attorney Secures Court Order Prohibiting Retaliation in Emergency Tenant Protection Suit During the COVID-19 Pandemic
Oakland, CA – On Friday, July 10, an Alameda County judge issued a court order under the Tenant Protection Ordinance and the Tom Bane Civil Rights Act enjoining defendants Afamefuna and Anwulika Odiwe from retaliating against their former tenants. The court found that the City was likely to prevail on its Tenant Protection Ordinance and Tom Bane Civil Rights Act claims that the defendants, who are investors with a history of flipping houses for profit, engaged in an unlawful self-help eviction during the COVID-19 pandemic in violation of state and local laws. Among other things, under the guise of a fraudulent City notice, the landlords removed all of their tenants’ belongings from their home and changed the locks.

Defendant Anwulika Odiwe threatened to proceed with unpermitted construction work in response to the tenants asserting their rights, declaring that if tenants wanted to live “with no windows and no doors and no toilets … that’s on them.” After the City filed a lawsuit against the Odiwes, the moving company, and the master tenant, the City sought an injunction preventing the defendants from engaging in further harassment of the tenants. Defendants Pete’s Moving Company, LLC, and Rigomero Manzanarez, the master tenant, agreed to stipulate to such an injunction. Because the Odiwe defendants did not stipulate to the injunction, the City sought a court order against them. “Tenant harassment is on the rise as some landlords turn to unlawful actions to drive tenants out while the courts are closed to evictions,” City Attorney Barbara J. Parker stated. “There is no place in Oakland for these illegal and harmful self-help measures. We stand with tenants to prevent such appalling misconduct and secure their basic right to safely shelter in place during this pandemic.”

In late April, a counterfeit City of Oakland “red-tag” notice was posted on the front door of the property, telling the tenants that the house was unsafe for occupancy and that they needed to leave within ten days. The City never authorized a red-tag for the property. Yet in May, movers entered the property and removed the tenants’ belongings, including their beds, furniture, and clothing, without notice or the tenants’ permission—and despite their protests.

For over a week, the tenants remained without their possessions, forced to sleep on the floor and without locks on their doors. Defendants only returned the tenants’ beds, clothing, and other personal items after the City issued a demand letter and filed this case. The City’s lawsuit also seeks civil penalties, punitive damages, and fees, to be determined by the court.

This case was filed by the Neighborhood Law Corps and Community Lawyering and Civil Rights Unit as part of City Attorney Parker’s Housing Justice Initiative. The City Attorney launched the Housing Justice Initiative to significantly expand her office’s work protecting vulnerable tenants in Oakland’s diverse neighborhoods and holding abusive landlords accountable.

I think you get the idea. Re-elect Oakland City Attorney Barbara Parker. ‘

Also, given that Zennie62Media has not yet interviewed either Barbara Parker or her challenger Eli Ferran, this should not be interpreted as a stoppage of video interviews. The interviews are done so you can gain some feel for what each person is like and decide for yourself.

I am all for progressive taxation but this is the first time I have ever seen an Oakland City Council District Elections Candidate use class warfare as part of her campaign strategy.

In other words, from this Twitter post, the idea is to go after those perceived as wealthy to fund healthcare. Forget about using an creative financing tools like tax increment financing to get the job done.

Ok, since you asked, the simple explanation of tax increment financing is property tax is collected from building owners within a pre-determined boundary, added in a formula that causes a doubling function, and that projected annual revenue is used to retire a bond issue. In the case of Oakland, it could be a bond that pays for local health care, but in a way that does not call for class warfare.

Remember where you saw this first, because Carroll never called me. All I am providing is an example of understanding how to make government work for people. You gotta know what levers to pull and buttons to push.

Well, let’s see how a message more appropriate for a run for Congress works here in Oakland.

The uploaded video is from a vlogger with the Zennie62 on YouTube Partner Channel, then uploaded to and formatted automatically at the Oakland News Now site and Zennie62-created and owned social media pages. The overall objective is smartphone-enabled, real-time, on the scene reporting of news, interviews, observations, and happenings anywhere in the World and within seconds and not hours. Now, news is reported with a smartphone: no heavy and expensive cameras or even a laptop are necessary. The secondary objective is faster, and very inexpensive media content news production and distribution. We have found there is a disconnect between post length and time to product and revenue generated. With this, the problem is far less, though by no means solved.
