The East Oakland Stadium Alliance, the 17-member non-profit that says it’s a “a coalition of longtime local businesses, workers, labor organizations, and Oakland community members who are deeply concerned about the Oakland A’s’ proposal to leave behind their current Coliseum location in East Oakland and build a new stadium in the middle of Oakland’s thriving working waterfront,” has filed yet another lawsuit to stop the A’s ballpark project. And while the other lawsuits had varying degrees of technical merit, this latest one is purely frivolous in the opinion of this long-time Oakland vlogger.

The East Oakland Stadium Alliance’s lawyer and friend to this space Mike Jacob, titled “ vice president of the Pacific Merchant Shipping Association” filed a lawsuit in Alameda County Superior Court challenging The San Francisco Bay Conservation and Development Commission’s decision last month to eliminate Howard Terminal’s Port Priority Use designation as Jacob claims the commission “failed to take into account environmental impacts of the A’s proposed stadium and surrounding development project,” Mike Jacob argued that the commission should have allowed for more in-depth analysis on the staff recommendation: “There is absolutely no question that there are significant environmental impacts. It’s more complicated than the A’s and the city would like it to be. They are trying to push something through, but that’s not how you do regional planning and that’s not how our system is set up.”

Mike’s a seasoned and very good lawyer, so I’ve got to believe this new lawsuit was the result of pressure from his bosses. First, let’s face it: if the BCDC decision had went the way the East Oakland Stadium Alliance had wanted, Mike would not be running to court claiming that “we won, but it wasn’t done correctly, so we want a reconsideration.” The fact that Jacob would admit he would not do that, on its face, makes the lawsuit invalid. Mike allowing himself to be reduced to saying “that’s not how you do regional planning and that’s not how our system is set up” is a pure matter of opinion, not backed by legislation outside of BCDC’s normal charge.

The idea of the California Environmental Quality Act (CEQA) guidelines is to evaluate the envrionmental impact of Howard Terminal. Regardless of Mr. Jacobs objections to the approval of the Final EIR, it was done. It’s not within the scope of responsibilities for BCDC to effectively re-evaluate the EIR. BCDC’s normal charge is as follows: “The San Francisco Bay Conservation and Development Commission (BCDC) protects and enhances San Francisco Bay and encourages the Bay’s responsible and productive use for this and future generations. “

It’s important to understand BCDC’s role. The San Francisco Bay Conservation and Development Commission holds discretionary review authority over projects that could result from the approval of the DEIR. BCDC will potentially rely on the Final EIR to support BCDC’s planning and regulatory work along the San Francisco Bay waterfront. So, BCDC renders an opinion, but is not final judge and jury in the EIR process. So, an EIR can be approved, but BCDC can kill a project that has a well-done EIR, and because it determines that the project may hamper future cargo handling capabilities.

Moreover, BCDC does consider environmental justice and social equity issues in it’s decision making. But what Jacob seems to really want is an outcome where BCDC effectively kills the EIR. He’s really trying to short-circuit the whole deal with this crazy lawsuit. That’s not happening if the City of Oakland and the Port of Oakland have their collective legal act together.

So, what really needs to happen here? Simple. Oakland Mayor Libby Schaaf and her staff must bite the bullet and call one giant meeting bringing the A’s and EOSA parties together with the objective of settling all lawsuits and disagreements in one meeting. That’s something Libby must call for right now, otherwise, we’re going to be subjected to a flood of lawsuits, one more wild-haired than the next, for however long it takes until Howard Terminal’s killed. That’s what the EOSA wants, and Libby needs to realize that and do the hard work of fusing the parties together.

Or, Libby can do the smart thing and hire me to take care of it. And in this case, I’d turn around and bring in former Oakland Mayor Elihu Harris and former City Councilman and Lawyer, John Russo, to help me. Why? Because both have key negotiating experience in these matters in Oakland. Elihu’s history is the stuff of legend. In the case of Russo, when he became Oakland’s first elected lawyer, John saw the mess of lawsuits with the Warriors and got together with them to settle them all in one fell swoop. That’s what needs to be done, and right now.
